This Privacy Policy explains how we collect, use, store and disclose personal information when you use our website, make an enquiry, book a consultation or engage us to provide migration services.

Information we collect

The personal information we collect depends on your dealings with us and may include your name, contact details, date of birth, nationality and citizenship, passport and visa information, employment and education history, family and relationship information, financial information and other information relevant to your migration matter.

Where necessary to provide migration advice or assistance, we may also collect sensitive information, including health information, criminal or character information and information about racial or ethnic origin or other matters relevant to Australian immigration requirements.

We may collect information directly from you, from documents you provide, through our website and online forms, during consultations, through our booking system, or from third parties where you have authorised us to obtain the information or where collection is otherwise permitted by law.

How we use personal information

We may use personal information to:

  • respond to enquiries and arrange consultations;

  • assess migration options and provide immigration assistance;

  • prepare, lodge and manage visa, sponsorship, nomination, review and other migration-related applications;

  • communicate with the Department of Home Affairs, the Administrative Review Tribunal, skills assessing authorities, State or Territory authorities and other relevant bodies where required;

  • manage client files, accounts, payments and our professional obligations;

  • operate and improve our website and business systems; and

  • comply with legal, regulatory and professional obligations.

Storage and security

Client files and documents are primarily stored in our secure migration practice management system, Migration Manager, which stores data in Australia. Clients are encouraged to provide and upload documents through the secure client portal wherever possible.

Some information and documents may also be received by email or stored on secure local computer systems as part of the management of a client matter.

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Access to client information is restricted to persons who require it for the operation of the practice or the provision of services.

Client files are retained in accordance with our professional and legal obligations.

Third-party service providers

We use third-party providers to support the operation of KMS Migration Advisory. These may include providers of email and cloud services, website hosting, online appointment scheduling, video conferencing, payment processing and other business systems.

Our migration practice management system stores client data in Australia. Other service providers may use systems located in Australia or overseas. Where personal information is handled by third-party providers, we take reasonable steps appropriate to the circumstances to ensure that it is handled securely and consistently with our privacy obligations.

Artificial intelligence and technology

We may use artificial intelligence, machine learning and other technology-assisted tools to assist with tasks such as research, document review, drafting, data analysis, first-pass translation, note-taking and administrative support.

These tools are used to assist our work and are not relied upon as the sole basis for migration advice or decision-making. Material generated using such tools is subject to appropriate professional review before it is relied upon or provided as migration advice.

Where reasonably practicable, we limit, redact or omit personal information provided to technology-assisted tools and take reasonable steps when selecting and using third-party providers.

Payments and bookings

Online consultations may be booked through our appointment scheduling system and payments may be processed by third-party payment providers. Those providers may collect and process payment and transaction information in accordance with their own privacy policies.

KMS Migration Advisory does not require clients to provide payment card details directly to us where payment is processed through an external payment provider.

Marketing communications

From time to time, KMS Migration Advisory may offer newsletters, migration updates or other information about our services and developments in Australian migration law.

We will only send electronic marketing communications where permitted by law. Where you have subscribed or otherwise agreed to receive these communications, you may unsubscribe at any time using the unsubscribe facility provided or by contacting us.

Unsubscribing from marketing communications will not prevent us from sending communications necessary to respond to an enquiry, manage a consultation or provide services to you.

Disclosure of personal information

We may disclose personal information where reasonably necessary to provide our services, including to government departments, tribunals, assessing authorities, State or Territory authorities, interpreters, translators, medical or other professional service providers and other persons or organisations involved in your matter.

We may also disclose information where required or authorised by law or with your consent.

We do not sell personal information.

Access and correction

You may request access to personal information we hold about you or ask us to correct information that is inaccurate, incomplete or out of date.

In some circumstances, access may be restricted or refused where permitted by law. If that occurs, we will explain the reason where we are permitted to do so.
